Club & Service Agreement Details
Not insurance. Memberships and The Water Works Plan are service agreements between you and Dwyer Water Wells, PLLC. They are not insurance policies, are not issued by an insurance company, and are not a substitute for homeowners insurance. No coverage is provided for property damage, liability, or losses outside the covered well-system work described on this page and in your written enrollment terms.
Program Levels – Steady Flow and Well Shield are preventive maintenance memberships (scheduled inspections, priority scheduling, and member discounts). The Water Works Plan includes all Well Shield maintenance benefits and adds a residential service agreement for covered repair/replacement of enrolled well-system components, subject to the benefits, exclusions, trip fee, and annual cap on this page and in your enrollment terms.
Who performs the work (The Water Works Plan) – Covered services are performed by Dwyer Water Wells, PLLC (or technicians we assign). This is an agreement for us to diagnose and repair/replace covered equipment up to the annual benefit cap — not a promise to pay cash to you or to a third-party contractor of your choice. Obligations of the provider under The Water Works Plan service agreement are backed by the full faith and credit of Dwyer Water Wells, PLLC.
Response Times – Response times are our standard for active members within our service area during business hours (Monday–Friday) and are not a guarantee of a specific arrival time; weather, road and site access, parts availability, safety, and crews already committed to another emergency service call can delay a visit. Steady Flow: on site within 3 business days. Well Shield: on site the next business day; no-water calls received before noon are seen the same day when a crew is available. The Water Works Plan: no-water calls go to the front of the line for a same-day or next-morning visit; after-hours and weekend visits are available at a reduced member rate. For covered repair requests under The Water Works Plan, under normal circumstances we will initiate performance of services within about 48 hours (or the next business day if the request falls on a weekend/holiday).
Benefit cap & trip fee (The Water Works Plan) – Covered parts and labor on repair claims credit toward a $10,000 maximum benefit per membership year. A $125 member trip/dispatch fee applies to each covered repair/claim visit (due when that service is scheduled or performed). The two scheduled Well Shield maintenance visits included with The Water Works Plan do not carry the $125 trip fee. Amounts above the annual cap, non-covered items, and applicable trip fees are the customer’s responsibility. Water Works Plan members receive the 15% member discount on parts and labor for non-covered repairs.
Eligibility & exclusions (summary) – The Water Works Plan is intended primarily for wells drilled and/or pump systems installed by Dwyer; other systems may require inspection and written acceptance before enrollment. Pre-existing defects, lack of maintenance, misuse, freeze damage from inadequate protection, lightning/flood/act of God unless expressly included in enrollment terms, water treatment equipment (unless added in writing), well yield / dry-hole / redrill to increase production, contamination, and work outside our service area are not covered unless your written enrollment says otherwise. Vehicle or third-party damage to the well may be excluded or limited — see enrollment terms.
One Well Per Membership – Each membership covers one well and its pump system only; it does not extend to other wells on the same property or owned by the same customer unless they are added to the membership with the Additional Wells add-on. Additional wells may be added at $25/mo per well on Steady Flow, $37/mo per well on Well Shield, or $53/mo per well on The Water Works Plan. All wells on one membership must be on the same plan, must be on the same property or an adjoining property, and are serviced on the same visit. On The Water Works Plan, the $10,000 annual benefit cap is one shared cap per membership across all wells on it, not a separate cap for each well. Wells at a separate location need their own full-price membership. At enrollment we photograph each well and its system and list each well on the membership, and only the wells shown in those enrollment photos and listed on the membership are covered by the plan.
Filtration System Add-On – A filtration/treatment check is included at no extra charge with Well Shield and The Water Works Plan when a system is installed. Steady Flow members may add a filtration system inspection for $12/mo per system (such as a water softener, sediment/carbon filter, UV disinfection system, or iron/sulfur filter). The inspection is done at your scheduled maintenance visit and includes a check of bypass and valve settings, a hardness/iron spot check, and a cartridge change if you supply the cartridge. The filtration inspection is an inspection only and does not cover filtration repairs. Salt, media, cartridges, parts, and repairs are billed separately; Water Works Plan members still receive the 15% member discount on parts and labor for non-covered repairs. Like wells, each filtration system on the add-on is photographed at enrollment and listed on the membership.
Scheduled Maintenance Visits – Scheduled maintenance visits are performed in two seasonal service windows each year, spring (around May) and fall (around November), timed to prepare your system for summer demand and for winter. New members are added to the next upcoming service window after enrollment; joining mid-season does not trigger an immediate visit. Repair and emergency service calls are available year-round under your plan’s response times. Visits are scheduled by service route, so your visit will typically fall on about the same day each season. You’ll receive an automatic reminder of your scheduled visit date ahead of time, and if you need a different day, just let us know. Visit dates may shift with weather.
Repairs Found During Maintenance Visits – Any issue found during a scheduled maintenance visit requires an approved estimate before repairs are made. If the repair can’t be completed during that visit, it will be scheduled for a later visit. For The Water Works Plan, covered repairs are applied to the plan benefit as described above.
Membership Options – Plans are billed monthly. Members pay the stated amount each month until the membership is terminated in writing.
Card on File & Automatic Billing – A valid credit or debit card must be kept on file for every membership. By placing a card on file, you authorize Dwyer Water Wells, PLLC to automatically charge the monthly membership amount to that card each month until the membership is terminated. If a payment is declined, the membership may be paused until a valid card is provided.
Non-Refundable – Once a membership month starts, dues for that month are non-refundable.
Modification – Dwyer Water Wells, PLLC may modify, update, or discontinue any plan or pricing with reasonable notice. You may cancel before the next monthly term if you do not accept the change.
Termination & Renewal – Either party may terminate by written notice. Benefits end on termination; unused time is not refunded. Memberships auto-renew each month unless terminated before the next term starts.
Governing Law – For wells and services in Arkansas, this agreement is governed by Arkansas law. For wells and services in Texas, this agreement is governed by Texas law (including applicable residential service-contract rules). Venue is in a court of competent jurisdiction in the state where the enrolled well is located, unless your written enrollment states otherwise.
Entire Agreement – This page plus your written enrollment/confirmation from Dwyer Water Wells, PLLC is the entire agreement for the plan you purchase and supersedes prior oral or written discussions about memberships.
